Please read these Terms carefully. By accessing www.pestpunt.com or scheduling any service with PestPunt, you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
1 Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and PestPunt ("PestPunt," "we," "us," or "our"), a California-based pest control services company, regarding your use of our website located at www.pestpunt.com ("Site") and any pest control or related services we provide ("Services").
By using our Site, requesting a quote, scheduling a service, or signing a service agreement, you acknowledge that you have read, understood, and agree to these Terms and our Privacy Policy, which is incorporated herein by reference.
2 Services Provided
PestPunt provides residential and commercial pest control services in California, including but not limited to:
- Attic rodent inspection, removal, and exclusion
- Rodent and wildlife trapping and live removal
- Attic insulation decontamination and restoration
- Entry-point sealing and structural exclusion
- Ongoing pest monitoring and prevention programs
- Commercial pest management programs
All services are performed by or under the supervision of licensed California Structural Pest Control (SPC) professionals. Specific services, scope, and pricing are defined in the written service agreement or estimate provided before work begins.
3 Service Area & Availability
PestPunt serves locations throughout California. Service availability may vary by location, technician availability, and seasonal demand. We reserve the right to decline service requests in areas where we cannot safely or legally operate.
Same-day and emergency services are offered subject to technician availability and are not guaranteed. PestPunt will make reasonable efforts to fulfill same-day requests received before 12:00 PM local time.
4 Estimates & Pricing
All estimates provided — by phone, online, or in person — are non-binding approximations based on the information available at the time. Final pricing is determined following an on-site inspection and is documented in a written flat-rate quote prior to service commencement.
- Estimates do not constitute a contract or guarantee of service.
- Prices may vary based on the scope, severity, and complexity of the infestation.
- Additional charges may apply for access difficulties, hazardous conditions, or work outside the original scope, with your prior written approval.
- Multi-visit service programs are priced on a per-program basis. Prices are locked for the duration of any signed program agreement.
5 Payment Terms
Payment is due upon completion of service unless otherwise agreed in writing. We accept major credit cards, debit cards, checks, and electronic bank transfers.
- Deposits: Projects exceeding $500 may require a deposit of up to 50% prior to scheduling.
- Late Payments: Invoices unpaid after 30 days will accrue interest at 1.5% per month.
- Returned Checks: A $35 fee will be charged for returned checks.
- Collections: Accounts more than 60 days past due may be referred to a collections agency. Customer is responsible for all reasonable collection costs, including attorney's fees.
6 Cancellation & Rescheduling Policy
- Standard Appointments: Cancel or reschedule at least 24 hours in advance at no charge.
- Same-Day Cancellations: Cancellations with less than 4 hours' notice may incur a $75 service call fee.
- No-Show / Access Denied: If our technician arrives and cannot access the property, a $75 trip charge applies.
- Emergency/Same-Day Appointments: Once dispatched, emergency service appointments cannot be cancelled without incurring the trip charge.

7 Service Guarantee
PestPunt stands behind its work. Our standard guarantee terms are:
- Exclusion Services: 12-month guarantee against re-entry through sealed points. If rodents breach a sealed entry point we treated within the guarantee period, we will re-seal at no additional charge.
- Trapping & Removal: Follow-up visits included until active infestation is resolved, per the service agreement.
- Insulation Replacement: Materials carry the manufacturer's warranty; labor is warranted for 90 days.
Guarantee Exclusions: Guarantees are void if the property sustains new structural damage, if the customer makes modifications to sealed entry points, or if the property is used for agricultural purposes attracting additional wildlife.
8 Customer Responsibilities
To enable safe and effective service, you agree to:
- Provide accurate information about the infestation, property, and access conditions.
- Ensure safe access to the property at the scheduled time, including attic hatches, crawl spaces, and exterior areas.
- Remove pets from treatment areas and follow all pre-service preparation instructions provided by your technician.
- Disclose known hazards, including mold, asbestos, structural instability, or hostile animals.
- Not modify, cover, or remove exclusion materials, traps, or bait stations installed by PestPunt without our prior authorization.
9 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY CALIFORNIA LAW:
- PestPunt's total liability for any claim arising from our services shall not exceed the total amount paid by you for the specific service giving rise to the claim.
- We are not liable for indirect, incidental, consequential, punitive, or special damages, including loss of use, loss of data, or lost profits.
- We are not liable for pre-existing structural damage, mold, or pest conditions that were not disclosed or discoverable during our inspection.
- We are not liable for damage caused by the customer's failure to follow pre-service or post-service instructions.
Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud by PestPunt.
10 Intellectual Property
All content on www.pestpunt.com — including text, graphics, logos, images, service descriptions, and code — is owned by or licensed to PestPunt and is protected by U.S. and California copyright and trademark laws.
You may not reproduce, distribute, modify, or create derivative works from any site content without our prior written permission. Limited use of content for personal, non-commercial reference is permitted with attribution.
11 Partner & Affiliate Referrals
PestPunt operates a network of licensed partner pest control companies throughout California. You acknowledge and agree that:
- Your service request may be fulfilled by a licensed PestPunt partner or subcontractor in your area.
- Partner contractors are independent businesses. PestPunt is not liable for acts or omissions of independent partner contractors beyond our network quality standards.
- PestPunt may receive referral fees or commissions when we refer customers to partner businesses for services outside our scope (e.g., home inspection, restoration, structural repair). Such referrals will be disclosed at the time they are made.
- If PestPunt is referred a lead through an affiliate or partner, the terms governing that referral are between PestPunt and the referring party and do not affect your rights as a customer.

12 Dispute Resolution
We encourage you to contact us first to resolve any dispute informally. If a dispute cannot be resolved through good-faith negotiation within 30 days:
- Binding Arbitration: Disputes shall be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules, conducted in Sacramento County, California.
- Class Action Waiver: You waive the right to participate in class action lawsuits against PestPunt.
- Small Claims Exception: Either party may bring claims in California small claims court for disputes within the jurisdictional limit.
13 Governing Law
These Terms are governed by and construed under the laws of the State of California, without regard to conflict-of-law principles. Any arbitration or legal proceeding shall be conducted in Sacramento County, California.
14 Changes to These Terms
PestPunt may update these Terms periodically. Material changes will be posted on this page with an updated effective date. Continued use of our Site or Services after changes are posted constitutes your acceptance. We recommend reviewing this page periodically.
